5. Do We Use Cookies and Other Tracking Technologies?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We use cookies and similar technologies to:

You can control cookies through your browser settings. Note that disabling cookies may limit some platform functionality.

Analytics

On pages for visitors who are not signed in, we use Google Analytics and Google Tag Manager to understand how the site is used, and the Meta Pixel to measure our advertising. These tools receive the address of the page you visit and standard browser information. None of them load once you are signed in, or on the chat page, the attachment style test, the crisis protocol, password-reset pages or therapist search results, and they never receive what you write in Wellzy.

6. Do We Offer Artificial Intelligence-Based Products?

In Short: We offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies.

As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with wellness support. The terms in this Privacy Notice govern your use of the AI Products within our Services.

Use of AI Technologies

We provide the AI Products through third-party service providers ("AI Service Providers"). Our AI companion runs primarily on DeepSeek. If DeepSeek is unavailable, we use OpenAI instead; OpenAI also screens messages for safety, transcribes voice messages, reads replies aloud and describes images you send. As outlined in this Privacy Notice, your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products. You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.

Our AI Products

Our AI Products are designed for the following functions:

  • AI wellness conversations and emotional support
  • Personalized coping strategies and wellness guidance
  • Journal analysis and insights
  • Mood tracking and pattern recognition

How We Process Your Data Using AI

All personal information processed using our AI Products is handled in line with our Privacy Notice and our agreements with third parties. The text of your chat messages and the AI's replies is encrypted in our database, and what we send to our AI providers to generate a response is encrypted in transit (TLS). Some information derived from your conversations, such as memory notes, reflections and the search index Wellzy uses to remember past conversations, is protected by access controls but is not separately encrypted.

Important: Your personal information and identifiable conversations are never used for AI model training or shared with third parties for marketing purposes. We may use anonymized and aggregated conversation data to improve our AI's responses.

Third-Party AI Data Processing

To provide our AI-powered wellness features, your data is processed by the following third-party AI service providers:

  • DeepSeek — Our primary AI provider. Your messages, with the context described below, are sent to DeepSeek's API to write Wellzy's replies, and also to remember what matters across conversations, write your reflections and wellness plan, and run safety checks. DeepSeek is a company based in China, and data sent to it may be processed there. Data is encrypted in transit via TLS.
  • OpenAI — Used to write replies when DeepSeek is unavailable, and to screen messages and replies for safety, transcribe voice messages, read replies aloud, and describe images you send. OpenAI states that it does not use data submitted via its API to train its models, in accordance with their API data usage policy. Data is encrypted in transit via TLS.

Voice recordings you submit are sent to OpenAI for transcription, and replies you ask to hear are sent to OpenAI for speech.

All data shared with these providers is encrypted in transit. We do not send your email address, username or account ID to these providers. To write replies that fit you, what we send includes your first name (if you've added one), your age, your companion's name and details Wellzy remembers from your conversations. OpenAI also receives a pseudonymous code derived from your account, which helps it detect abuse; the code does not reveal who you are. By using our AI-powered features, you consent to this processing. You may withdraw consent at any time by discontinuing use of the AI chat features.

7. Do We Use Social Logins?

In Short: No. You sign in to Wellzy with your email address and password.

Wellzy does not currently offer sign-in with Google, Apple or other social accounts, so we do not receive profile information from them. If we add social login, we will update this notice before it launches.

8. Is Your Information Transferred Internationally?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information. Our main AI provider, DeepSeek, is based in China, and the content described in section 6 may be processed there.

If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law.

By using Wellzy, you consent to the transfer of your information to the United States and its processing in accordance with this Privacy Policy and U.S. law.

9. How Long Do We Keep Your Information?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law.

When you delete your account:

  • Your account is deactivated right away and permanently deleted about 30 days later, together with your conversations, memory, reflections, journal and mood entries, goals and the other content linked to it. Until then, you can ask us to restore it.
  • We keep a small number of records after that: safety records such as crisis alerts and content reports (with a copy of the account email), a record that the account was deleted, sign-in security logs (email and IP address), and billing records held by our payment processors.
  • Voice recordings and images you sent, and copies of conversation text in our server logs, are not yet removed automatically when an account is deleted. Email us and we will delete them.
  • Anonymized usage data may be retained for analytics, and legal or regulatory data as required by law.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible, then we will securely store your personal information and isolate it from any further processing until deletion is possible.

10. How Do We Keep Your Information Safe?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process, including:

  • Encryption in transit: Data sent to and from Wellzy, and to our AI providers, is protected with TLS (1.2 or 1.3)
  • Encryption at rest: The text of your chat messages and the AI's replies is encrypted at the application level in our database (Fernet: AES-128-CBC with HMAC). Other information we keep, including memory notes, reflections, goals, mood and journal entries, voice recordings and images, is protected by server access controls but not separately encrypted
  • Restricted access: Only authorized personnel can access user data, and only for the purposes described in our Terms (Section 7)
  • Security reviews: We regularly review our security controls
  • Infrastructure: Hosted on Amazon Web Services servers in the United States

However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. We will notify you as required by law in the event of a data breach.

10a. Consumer Health Data

In Short: What you tell Wellzy about your mental health is health data. We never sell it, and we never send it to advertisers.

Some of what you share with Wellzy — your messages, mood check-ins, journal entries, reflections, and the inferences Wellzy draws from them — is "consumer health data" under state laws including the Washington My Health My Data Act, Nevada SB 370, and the Connecticut Data Privacy Act. This section applies to everyone, and it gives residents of those states specific rights.

What we commit to

  • We do not sell your consumer health data. Not to anyone, for any price, under any definition of "sale" in these laws.
  • We do not share it with advertisers. There are no advertising pixels, ad-network SDKs, or marketing trackers on the pages where you chat, journal, or check in, and we do not upload user lists to advertising platforms.
  • We collect it only to run the service — generating responses, remembering context between conversations, producing your reflections, and meeting our safety and legal obligations.
  • We do not use geofencing around any health facility.

Your rights

You can ask us to confirm whether we hold consumer health data about you, tell you who we have shared it with, and delete it, as described in our retention section. Exercise these rights from your account settings or by emailing wellzycare@gmail.com. We will not charge you or degrade your service for exercising them.

About HIPAA

Wellzy is not covered by HIPAA. HIPAA applies to healthcare providers, health plans, and their business associates. Wellzy is a consumer wellness app and is none of those, so your conversations here do not carry HIPAA protections. We describe our encryption and access controls above so you can judge them on their own terms rather than by comparison to a law that does not apply.

11. Do We Collect Information From Minors?

In Short: No. Wellzy is for adults 18 and over, and we do not knowingly collect information from anyone under 18.

Wellzy is not directed to children or teenagers. You must be 18 years of age or older to create an account, and by using the Services you represent that you are. We do not knowingly collect, solicit data from, or market to anyone under 18, and we never sell personal information about anyone.

If we learn that an account belongs to someone under 18, we will deactivate it and take reasonable measures to promptly delete the associated personal information. If you believe we hold information about someone under 18, contact us at wellzycare@gmail.com.

12. What Are Your Privacy Rights?

In Short: Depending on your state of residence in the US or in some regions, such as the European Economic Area (EEA), United Kingdom (UK), Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information.

In some regions, you have certain rights under applicable data protection laws. These may include the right:

  • To request access and obtain a copy of your personal information
  • To request rectification or erasure
  • To restrict the processing of your personal information
  • If applicable, to data portability
  • Not to be subject to automated decision-making

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Log in to your account settings and update your user account
  • Contact us using the contact information provided

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Withdrawing your consent

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. You can withdraw your consent by contacting us or updating your preferences. However, please note that this will not affect the lawfulness of the processing before its withdrawal.

13. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.
